1. Who we are

Horizon ("the service", "we", "us") is operated by Horizon Health Tracker ("the seller"). By creating an account or using Horizon you enter into a binding agreement with Horizon Health Tracker.

2. Acceptance

By accessing or continuing to use Horizon you agree to these Terms. If you do not agree, do not use the service. You confirm that you are of legal age in your jurisdiction and, if using Horizon on behalf of an organisation, that you have authority to bind it.

3. The service

Horizon is a personal body transformation tracker that helps you log weight, calories, steps, protein, waist measurements, and related metrics, and estimates a timeline toward your goal. Horizon is not medical, nutritional, or fitness advice.

4. Accounts

You must provide accurate information and keep your account credentials confidential. You are responsible for all activity under your account.

5. Acceptable use

You agree not to misuse the service. In particular you must not: (a) use it unlawfully or to defraud others; (b) infringe intellectual property; (c) send spam or malware; (d) probe, scan, or interfere with security features; (e) scrape, resell, or redistribute the service; or (f) reverse engineer it except where the law expressly permits.

6. Intellectual property

Horizon, including its software, design, branding, and content, is owned by Horizon Health Tracker and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the service within your chosen plan. You retain ownership of the data you enter and grant us a limited licence to host and process it solely to provide the service.

7. Payments and subscriptions (Merchant of Record)

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices, taxes, billing cycles, renewal, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, together with our Refund Policy.

Horizon Pro is billed monthly or yearly at the prices shown on our Pricing page at the time of purchase. Subscriptions renew automatically until cancelled. You can cancel at any time in the app or via the Paddle customer portal linked from your receipt.

8. Service availability

We work to keep Horizon reliable but do not guarantee uninterrupted or error-free operation. Features may change over time.

9. Warranties and disclaimers

To the fullest extent permitted by law, Horizon is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Horizon does not diagnose, treat, or prevent any medical condition. Consult a qualified professional before making significant changes to your diet or exercise.

10. Liability

To the fullest extent permitted by law, our aggregate liability to you for any claim arising out of or relating to the service is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, or special damages, including lost profits, lost data, or loss of goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify Horizon Health Tracker against claims arising from your content, your misuse of the service, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly violate our policies. You may stop using the service at any time. On termination, your right to use Horizon ends; local data on your device remains under your control.

13. Changes

We may update these Terms from time to time. Material changes will be notified in the app or by email. Continued use after changes means you accept them.

14. Governing law

These Terms are governed by the laws of the seller's jurisdiction, without regard to conflict-of-laws rules. Disputes will be resolved by the competent courts of that jurisdiction, unless mandatory local consumer law provides otherwise.
